9. Disclaimer of warranty.
Customer agrees that its use of Services and its reliance upon information provided are entirely at Customer's own risk. Customer acknowledges and agrees that we exercise no control over, and accepts no responsibility for, the content of data, scripts, or other information passing through our host computers, network hubs and points of presence or the Internet.
THE SERVICES PROVIDED UNDER THIS AGREEMENT ARE PROVIDED ON AN AS IS, AS AVAILABLE BASIS. NEITHER ITS OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES OFFERS ANY WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, FOR THE SERVICES OR ANY EQUIPMENT PROVIDED IN CONJUNCTION THEREWITH.

Customer agrees that we shall not be held responsible or liable for direct, indirect, special, accidental consecutive or exemplary damage, including but not limited to profit loss, of benevolence after utilisation, data or other intangible loss (even if we have been informed of the possibility of such damage), resulting or originating from:
(I) The use or the incapacity to use the Services
(II) The cost to obtain replacement merchandises and/or any services resulting of interaction with the Services.
(III) Non authorized access or modification of your data transmission
(IV) Declaration or behaviour of any third party on the Services
OR
(V) Any other matter related to Services.

(i) In case one disposition of the present Terms of Service is recognized as invalid by the court of one of the party, this disposition will be interpreted to reflect the original intentions of the parties according to the law, and the rest of the Terms of Service will stay intact and valid.
(ii) Failure from one or the other party to affirm any right under the present Terms of Services won't be considered as a renunciation to the right of any party and the right will stay intact and valid.
